1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Leads Sentry, including the desktop application, web platform, API services, documentation, and associated websites (collectively, the "Service"), operated by ListSense Suite ("Company," "we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and ListSense Suite.

You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.

2. Service Description

Leads Sentry is a professional email verification platform that provides:

• Multi-Layer Verification: Syntax validation, DNS record checking, SMTP handshake verification, catch-all detection, role-based email identification, and disposable email filtering.
• Desktop Application: A locally-installed application for Windows, macOS, and Linux that performs email verification on your machine.
• Web Dashboard: A web-based interface for managing verifications, viewing reports, and accessing account settings.
• API Access: RESTful API endpoints for programmatic email verification and integration with third-party systems.
• Reporting: Export verification results in CSV, JSON, Excel, and other formats.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, subject to applicable law.

3. Accounts & Registration

To use certain features of the Service, you must register for an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your account credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

You may not create multiple accounts for the purpose of abusing the Service or circumventing usage limits. We reserve the right to suspend or terminate accounts that violate these requirements.

4. License & Usage Rights

4.1 License Grant

Upon purchase, ListSense Suite grants you a non-exclusive, non-transferable, revocable license to use Leads Sentry subject to the terms of your purchased plan. The license is bound to a specific machine via hardware fingerprinting.

4.2 License Types

• Personal Edition: For individual use on a single machine. Not for commercial redistribution.
• Professional Edition: For professional and commercial use. Includes API access, priority support, and higher verification limits.
• Enterprise Edition: For organizations requiring multi-seat licensing, dedicated support, and custom integration.

4.3 License Restrictions

You may not:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the software.
• Modify, adapt, alter, translate, or create derivative works of the software.
• Rent, lease, lend, sell, sublicense, or distribute the software or your license key to any third party.
• Use the software on more machines than permitted by your license plan.
• Circumvent, disable, or interfere with license validation or security features.
• Use the software in violation of any applicable law or regulation.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to verify email addresses obtained without consent, through scraping, harvesting, or other unauthorized means.
• Use the Service to facilitate spam, phishing, or other forms of unsolicited communication.
• Attempt to overwhelm, overload, or interfere with the proper functioning of the Service or its infrastructure.
• Use automated tools to access the Service in a manner that exceeds reasonable usage limits or circumvents rate limiting.
• Transmit any malware, viruses, or other harmful code through the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service to discriminate against individuals or groups in violation of applicable anti-discrimination laws.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision.

6. Intellectual Property

The Service and all of its contents, features, and functionality — including but not limited to software, text, graphics, logos, icons, images, audio clips, data compilations, and the design, selection, and arrangement thereof — are owned by ListSense Suite, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Leads Sentry name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ListSense Suite. You may not use these marks without our prior written permission.

7. Payment & Refunds

7.1 Pricing

Pricing for our Service is described on our pricing page. We reserve the right to change our pricing at any time. Price changes will apply to the next billing cycle and will be communicated in advance via email.

7.2 Payment Terms

By selecting a paid plan, you agree to pay all applicable fees. Payment is due at the beginning of each billing period. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.

7.3 Refund Policy

We offer a 14-day money-back guarantee for first-time purchases. If you are not satisfied with the Service within 14 days of your initial purchase, you may request a full refund by contacting our support team. Refund requests after the 14-day period will be evaluated on a case-by-case basis.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the use of the Service will be accurate or reliable.
• The quality of any products, services, information, or other material purchased or obtained through the Service will meet your expectations.
• Any errors in the Service will be corrected.

You understand and agree that your use of the Service is at your sole risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ListSense Suite, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification clauses, and limitations of liability.

You may delete your account at any time by contacting our support team. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

11. Indemnification

You agree to defend, indemnify, and hold harmless ListSense Suite and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements including legal fees arising from or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or the rights of any third party.
• Any content you submit, post, or transmit through the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Continued use of the Service after any changes to the Terms constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and may request a refund in accordance with our refund policy.
